Contrato de Licença e Termos de Uso
Última atualização: 29 de julio de 2026
This License Agreement and Terms of Use (the “Terms” or the “Agreement”) is a legally binding contract between you (the “User”) and the owner of the Aluma platform, available at aluma.lat and its subdomains (the “Platform”, operated by “Aluma”, “we” or “us”). It governs access to and use of the Platform and all of its services, features and content. By checking the acceptance box, registering or using the Platform, you declare that you have read, understood and accept this Agreement in its entirety, as well as the Privacy Policy, which forms an integral part of it. If you do not agree with any of its provisions, do not check the box or use the Platform.
1. What Aluma is
Aluma is a technology tool that allows individuals and organizations (the “Creators”) to build online academies, courses and communities, sell their content and manage their students. Aluma provides the infrastructure; it is not the author, owner or party responsible for the content that Creators publish, nor for the relationship between Creators and their students (also “Users”).
2. Registration and account
To use the Platform you must create an account with truthful information and keep it up to date. You are responsible for the confidentiality of your password and for all activity on your account. You must be of legal age or have the authorization of your legal representative. Aluma may reject, suspend or cancel accounts that violate these Terms.
2.1. Identity verification (“verified account”)
You may voluntarily request identity verification to obtain a “verified account” badge. To do so, we may ask for your full name, your ID number (national ID (DNI) or another identity document) and one or more images of the document and/or a photo of yourself (selfie) that allow us to match your identity. This data is collected with your prior, express and informed consent and for the sole purpose of verifying that you are a real person and granting (or revoking) the badge.
Identity documents are sensitive personal data and receive enhanced protection: they are stored with restricted access and reasonable security measures, are not published or disclosed to third parties except where required by law, and are kept only for as long as necessary for the stated purpose. You may withdraw your consent and request deletion of this data at any time by emailing hola@aluma.lat, without affecting other aspects of your account. This processing is carried out in accordance with Argentina’s Personal Data Protection Law No. 25,326 and other applicable law; for more details, see the Privacy Policy. Verification is not required to use the Platform, and the badge may be granted, denied or withdrawn at the reasonable discretion of Aluma or of the community’s Creator.
3. Plans, pricing and payments
Aluma offers free and paid plans. Paid plans are billed as recurring subscriptions and may renew automatically until you cancel them. Prices may or may not include taxes, depending on your jurisdiction. Payments are processed through third-party providers (for example, Mercado Pago); Aluma does not store your full card details. Non-payment may result in the suspension of features or of the account.
Sales that a Creator makes to their own students are likewise processed through the payment provider. Aluma may charge a commission on those transactions, as disclosed on the Platform. The Creator is responsible for their tax obligations on their income.
4. Creator content
The Creator is solely responsible for the content they upload (courses, videos, text, images, forms, communications, etc.) and warrants that they have the rights to publish and sell it. By uploading content, the Creator grants Aluma a limited, non-exclusive, worldwide license to host, display and distribute it for the sole purpose of operating the Platform. The Creator retains ownership of their content.
It is prohibited to publish content that is illegal, infringes third-party rights (intellectual property, image rights, personal data), is misleading, violent or discriminatory, or promotes unlawful activities. Aluma may remove content or suspend accounts upon well-founded reports or violations, without giving rise to any right to compensation.
5. Acceptable use
You agree not to: (a) use the Platform for unlawful purposes; (b) compromise the security or normal operation of the service; (c) access other people’s accounts or data; (d) send spam or unsolicited communications; (e) resell or replicate the Platform without authorization; (f) use the Platform to infringe third-party rights.
6. Aluma’s intellectual property
The Platform, its software, design, brand and other elements are the property of Aluma or its licensors and are protected by law. These Terms do not grant you any rights in them beyond the permitted use of the service.
7. Artificial intelligence (AI) features
Aluma includes AI-assisted features (for example, generation of text, courses, summaries, quizzes, and a tutor for students). AI outputs are provided “as is,” may contain errors or inaccuracies, and do not constitute professional advice (legal, medical, financial or of any other kind). The Creator and the User are responsible for reviewing and validating such outputs before using or publishing them.
8. Cancellation and refunds
You can cancel your subscription at any time from your account; cancellation takes effect at the end of the period already paid, with no prorated refund unless applicable law provides otherwise. Refunds for purchases between a Creator and their students are governed by the policy the Creator communicates and by the consumer protection law in force.
8.1. Right of withdrawal (consumers in Argentina)
If you are a consumer and enter into a contract at a distance, you have the right to revoke your acceptance within ten (10) calendar days of entering into the contract or of receiving the service, at no cost and without giving a reason, under Article 34 of Argentina’s Consumer Protection Law No. 24,240. To exercise this right, use the Withdrawal Button (“Botón de Arrepentimiento”) available on the Platform or email hola@aluma.lat. Cancellation of subscriptions may be requested through the same simple means by which you subscribed (Cancellation Button, “Botón de Baja”).
8.2. Intellectual property complaints (DMCA / copyright)
We respect copyright. If you believe that content hosted on the Platform infringes your rights, send us a notice at hola@aluma.lat with: (a) your identification and contact details; (b) identification of the work allegedly infringed; (c) the URL or location of the content on the Platform; (d) a good-faith statement; and (e) your signature (physical or electronic). We will evaluate the complaint and, where appropriate, remove the content and notify the Creator, who may submit a counter-notice. This procedure is consistent with the U.S. Digital Millennium Copyright Act (DMCA) and Argentine intellectual property law.
9. Service availability
We strive to keep the Platform available continuously, but we do not guarantee that it will operate without interruptions or errors. We may perform maintenance, make changes or temporarily suspend the service. Some features depend on third-party providers (hosting, video, payments, AI, email) whose failures are beyond our control.
10. Limitation of liability
To the maximum extent permitted by law, Aluma will not be liable for: (a) the content, promises, income or results of Creators; (b) the relationship between Creators and their students; (c) indirect damages, lost profits or loss of data; (d) failures of third-party providers. Aluma does not guarantee that using the Platform will generate income or any specific financial results. Nothing in these Terms excludes liability that cannot be limited by law.
11. Indemnification
You agree to hold Aluma harmless from third-party claims arising from your content, your use of the Platform or your breach of these Terms.
12. Changes to the Terms
We may update these Terms. We will publish the current version with its update date. Continued use of the Platform after the changes means you accept them.
13. Governing law and jurisdiction
These Terms are governed by the laws of the Argentine Republic. In the event of any dispute, the parties submit to the competent ordinary courts under applicable law, without prejudice to the rights that consumer protection law grants to users.
If you access the Platform from the United States or another country, you do so on your own responsibility and you are responsible for complying with applicable local law. Nothing herein limits the non-waivable rights that the law of your jurisdiction grants you as a consumer.
